Welcome to Episode 10 (wow, double digits! We are on our way!) of Hello Fairview, your local podcast made right here in Fairview, for people in Fairview and the surrounding areas.  This is a weekly show, released every Wednesday, featuring stories that aim to inform and inspire.  Local Radio stations don’t exist in small towns like ours, so we will use Hello Fairview to fill that void with news related to Fairview.  This is a Value for Value podcast, which means you contribute what you can based on the value you receive.  This concept was founded by the PodFather himself, Adam Curry, and his Co-host, John C. Dvorak of the No Agenda Show, over 18 years ago.

Currently, this is a one-man operation, so if you have any ideas, events, business opportunities, or job openings, please don't hesitate to let me know.  You are a producer of this show; you are not the product, because your time and attention are not being sold to advertisers for value.  Some shows will be longer, others shorter, but I will do my best to keep things relevant. 

 

Traffic Time

Normal Busy, where you can wait 2-5 minutes to make a left in the morning and the afternoon.  Cumberland, and 100 is still getting some regular work. They are still working to build culverts on the East- and westbound sides to widen the road, along with some mini-bridges.  We are less than one year

Redlight Update – We currently still have three (Old Cox, Publix, & Walmart). Still, we will soon be getting one at the new City Center Entrance and at the Cumberland and 100 intersection when that expansion occurs. I’m not sure how it will help or hurt yet, but I hope the crossing guard can control it during the morning and evening school rush.

City Center – There will still be some construction closures here and there.

 

We’re Growing

City News

Commissioner Update – The Health Department, which is open across from the Elementary school and has recently been renovated, is ready to help.  They have a stock of vaccines if needed, as well as other medical services. Please go and check them out.

The Fairview Police Department Shop with A Cop is wrapping up.

City Blanket Drive – This was the first post I saw about it, but it’s been going on since last week on the 7th and will run until the 24th at City Hall, where they are accepting only new blankets to be given to residents.

Christmas Trees – There will be some at Meseck Chiropractic for the Scouts BSA Troop 297 here in Fairview.  Then there will also be Christmas Trees at Farm Fresh Vintage.  There may also be some others, but I will be on the lookout.  Black Friday is the best day to get them if you have time.

Special Elections Early Voting has Started – Please go and vote at the Fairview Recreation Center from November 19th through the 26th, from 8AM-6PM Weekdays, and Saturday will be 8 AM to 12 PM, with November 26th closing early at Noon!  There was even a trip from former Vice President Kamala Harris this week to help promote Aftyn Behn.

City Gossip – There seems to be a possible scandal brewing, but I’m hoping to see deeper reporting with FOIA requests and numbers. It’s being spread on social media, not on any news stations or newspapers yet.  The City Manager has supposedly hired Patti Carroll and Devon Halliburton for some City positions, and it’s a hybrid role, unlike most of the others there, with a possible city vehicle too.  We will have to see how it pans out and if anything takes off, but we don’t know all the details, but we know some pieces, so we will have to see how it goes.

  1. Citizen Comments
    1. Lady – Richvale Resident – She talked about some of the problems she is having with her home, which was built about a year ago. Multiple homes need repairs of 40-100k+ for major structural, framing, and mold issues.  Roof trusses that are not even touching the supports.  Told by the builder not to put anything heavy on the floor.  She mentioned that when there were quality problems and failed inspections, work shut down, but that isn’t happening this time.  She talked about how she has reached out to the builder and is getting no response, and how she has also reached out to the City Manager and Mr. Greer to see what’s going on.
    2. Man – Richvale Resident – Has only been in the house for less than 10 months and has electrical, paint, and flooring. There was an 8x12 hole where the floor was soft.  They also have major mold problems.  They live near lot six, and that’s one of their Spec homes that isn’t selling.  It's reportedly failing inspections, which is causing financing and the buyers to back out (Was under contract in June/July, with reportedly major structural and mold issues and 44% moisture in the basement).  He was an OSHA inspector and reported them; they are continually violating multiple laws.  He has also seen them install wet and moldy lumber into new houses.
    3. Man – Richvale Resident – 5 to 2” sag in their house and cracks throughout the house. There are repair bills ranging from 40 to 90 thousand dollars.  He mentioned that if there isn’t anything to do for their homes, they might be able to do something for any of the new houses.  Talked about a sagging concrete walkway.  Came out a 2nd time and he said the residents need help trying to do something with this large company, and they are hoping the city can help in some way, and would like to meet and talk about these issues outside of this event.
    4. Lady – Richvale Resident – Loved the opening prayer.  She started crying while trying to start, and her husband came up.  A foundation specialist came and said they need 36 jacks and more supports to try to fix their sagging floors for 77 thousand dollars.  They also have mold issues, and they had to repair water intrusion in the crawl space.  This shouldn’t happen to a new 900k home; it isn’t right or ethical, and they just want Brightland Homes and DRB to do the right thing.
    5. Man – Richvale Resident – He built DoD facilities and just moved here in July.  Talked about lots of cracks in the floor, and some of the joists have cracks.  There are still cracks in the drywall.  There is a problem with the house’s ventilation, causing moisture and mold, which should cost around 40 thousand dollars to fix.  He had to leave the house for 5 days due to the mold levels.
    6. Lady – Bought her house in September of last year, and they have found mold and fungus.  Moisture keeps coming in from the siding.  Brightland and DRB homes haven’t replied or done anything to fix these issues, yet they sent their one-year warranty pamphlet.  They have spent money trying to fix some of the mold, but they need help getting the builder to address these issues.

    3. Andy Davidson – Mentioned he is not the right guy for those issues, and he knows they have been trying to reach out to the HOA.  He mentioned they have met the requirements and that Phases 1-4 shouldn’t be related to this Phase 5.
    4. City Attorney - had to talk to the chair and tell her to get control of the situation because we are here to talk about Phase 5 and not other items. Some Richvale residents were talking back and forth with the DRB rep while he tried to say they care and will work to fix things.
    5. McDonald – In light of the Citizen Comments, what could we do? Directed to the City Attorney. After the attorney responded, he ceased questioning.
    6. City Attorney – This body focuses on zoning and planning requirements, and some of these issues would need to go to the Board of Commissioners. Those comments should have nothing to do with the phase 5 proposal in front of them. If it meets the city’s ordinances and planning requirements, you should vote for it; otherwise, you shouldn’t.  If those comments are true, that’s a terrible situation. There are remedies, but the planning commission cannot resolve them; they should hire attorneys.

    2. There was a question about whether one of the residents in this development was on well water or city water, but they were unable to find out. There was talk about erosion control and how that property should be unaffected either way, regardless of drainage from the construction. There was a question about the buffer along the Crow Cut road, and they responded that those properties are not required, but the builder will install a Semi-Opaque buffer. There was then a question about the definition, since many places use different definitions, and Mr. Greer said they don’t have a definition for that type of buffer.  There was another question about whether the builder intends to build the buffer.  They are showing a rear setback from 20 feet to 35 feet to help with the planning commission; they are increasing the setbacks to the other properties or the road.  The question asked what remedy they would have if they didn’t put it in; there wasn’t a requirement for a buffer, but there could be a conditional approval.  A question was asked about any official things that could be referenced in an official amendment for this property’s conditional approval.  The City Attorney asked if they are adverse to a conditional approval to this buffer and that it could be 36 feet.  Another question was raised about the 35 feet and how things would be done that way, and they responded that the drainage swell is why that extra space is in the easement, so that 20 feet is fine.
    3. A motion was made to install a landscape border along Crow Cut Road, with a perimeter at least 20 feet wide, and the staff will work on it.

    5. The Cove has 50 homes on 28 acres.

    3. There was a question about whether there was an opportunity to connect to Boone Road. There were some limitations due to drainage, the floodplain, and the cemetery's size.

    5. These homes will have sprinklers because there is just one road in and out.
    6. Mayor Anderson appreciated that they listened to the community and chose RS8 over RS5.
    7. There wasn’t a traffic study done because there weren’t 100 homes to meet the threshold.
    8. Question about the section about the future connection noted towards the town center, so there could be some possibilities later. There is Fairview Blvd frontage to the west of the property, which is developed, so these residents could access City Center and Cedar Crest.  There were questions about how it would be created and whether it would be noticeable, and it wasn’t going to be very noticeable.  There was a discussion about the Storm Water Ordinance and the Zoning Ordinance being in conflict, and we need to clean this up because the property has steep slopes.

  13. City Planning Staff Reports
    1. Talked about the Development Code and how there are currently 194 comments submitted to it, with around 50 that were related to the Old Harding Conditional use for the race track that were submitted. Attached are those reports; they didn’t get them to the board that early, but it was before the meeting. There were questions about how we would amend the development code. That would be brought to the staff, who would draft a resolution for the planning commission, which, once approved, would go to the board of commissioners for final approval.  The city attorney mentioned that other cities do this regularly, but it's best to save a couple of them for a batch rather than doing them one at a time.  Questions were asked about how the public could be found, and it was noted that it is associated with the agenda.
    2. There were questions about the certificate of occupancy, and in light of the public comments for Richvale, what could we do? They adhere to codes recognized internally.  https://www.iccsafe.org/products-and-services/i-codes/2018-i-codes/irc/ Some inspections have to be completed.  A question was asked about whether a structural engineer is needed to approve this, and he said no, that isn’t required for residential.  Greer would love to have this reviewed, and another email will be sent next week with the staff comments on the public comments.  There is an open position for an associate planner.  They asked about whether 2 hours was enough time, he believes it should be as long as it's reviewed before the meeting, and maybe some questions are asked before.  There may need to be another meeting, and if so, it’s covered by the current contract.

    1. Talked about the Richvale residents, and he has been working with them as much as they can, and they have empathy for this situation. We have requested that the inspections be sent to the planning staff and that a list of options be prepared for what we can do, and that this be emailed soon.  There is only so much the City can do in a situation like this, and once ownership of the property has been taken, after the building process is complete.

      1. She mentioned how frustrated she is hearing the news about these Richvale residents, and as a person, she cares about them and will do what she can, but she will also work in her official capacity where she can. She also talked about how nice the development is,  and that our homes is the single most expensive item we will buy.  It disturbs her that there are houses with these kinds of issues, and she has a problem with one or more than 15 of them.  I don’t know the exact logistics of what we can do, but you are our neighbors.  Little things that can be fixed are one thing, but structural and mold issues are just so crazy.  Citizen Lisa says they shouldn’t be able to build here, but Mayor Lisa has to allow it if it meets the codes, and that’s why I abstained on this vote, too.  She wanted something like stopping work until things are fixed, but that may not be legally possible, and she will research more about the city and other options.  She is worried that they are not stalling on this one-year warranty until it expires because that’s wild.

The State of TN (Not In Order)

  1. The government is still shut down is done! , yaaayyy. Now that only buys us some time and will require more votes and deals to be made before another shutdown could happen again when this continuing resolution expires.
  2. Former Vice President comes to support Aftyn Behn at a rally, holding a megaphone.
  3. Our governor is planning to appeal a ruling from a Davidson County chancellor on Monday that temporarily blocked Gov. Bill Lee from continuing to deploy the Tennessee National Guard in Memphis.
  4. December 2 will be the final special election for the 7th District US House Seat, with Aftyn Behn for the Democrats and Matt Van Epps for the Republicans, based on the primary results. Turnout was down 75% in the Middle TN U.S. House special election, particularly in GOP strongholds.
  5. Music City Loop is about to really start digging, and some of the large machinery moves in. There is even more news that there may be as many as 20 stops along the way, but I don’t see how that would work well when the Las Vegas Tunnel has just one, and it’s not that fast or efficient like a rail system would be.
  6. Today, the Tennessee Department of Education (TDOE) announced key dates for the Education Freedom Scholarship (EFS) Program’s second year of implementation. It encouraged interested families across the state to apply for the universal school choice program that allows parents to choose the school that best fits their child’s needs, regardless of income level or zip code.

How’s the hill, weather report

Back to it, How’s the hill?  Passable. Rainy and getting colder soon.  The weather guessers are predicting highs in the 60s, with lows in the 20s starting next Wednesday.

Nothing New was spotted.  Ace Hardware is still brewing.  Other than that, I spotted nothing new this week, and I'm waiting to see what else is coming.  There are still a couple of properties for sale around the area.

Farmers Market

Make sure to head to the Farmers Market every Saturday Morning, 8 AM to 12 PM (Not Earlier, as other posts have posted) at Meseck Chiropractor and Fairview Fresh Deli for their life-changing Apple Fritters, located down the road from Publix.  There are so many good places to get local beef and pork, breads and treats, local fruits and vegetables, along with some hot sauce, fishing lures, and other holiday gifts this time of the year.

History Nugget

Cherokee Hill Lane - Name Origin

The area now known as Fairview was first inhabited by Native Americans, including Cherokees, Chickasaws, Choctaws, Creeks, and Shawnees. They used the ancient Natchez Trace, which runs close to the center of what is now Franklin, on their hunting trips to Mississippi. In 1798, the first white settlers arrived in the area.

For the Kids

There are tons of activities and sports in Fairview to keep your kids engaged.  There are some cheer programs and recreation teams for Baseball, Basketball, Football, and others. There is a thriving Girl Scout and Scouts BSA Programs in Fairview.  If you have a homeschooler, always check the Bowie Park schedule for clubs that meet there.  There is also LaLa’s Dance Studio and Elevate Gymnastics and Cheer.  There is also an excellent Taekwondo and Jujitsu school that teaches more than just moves, called Vigilance Martial Arts.  We also have a great wrestling program with some summer options.
